About this Personal Data Protection Terms and Conditions

The Personal Data Protection Act 2010 was introduced to regulate the processing of personal data in commercial transactions. The Act applies to all companies and firms that are established in Malaysia and requires ExcelVite Sdn. Bhd. and/or its subsidiaries, associates, affiliates and/or members within the ExcelVite Sdn. Bhd. group of companies (collectively “ExcelVite”) to inform you of your rights in respect of your personal data that is being collected, recorded, used, retained or stored by ExcelVite and the purposes for the data processing. The Act also requires ExcelVite to obtain your consent to the processing of your personal data. For the purpose of the Terms and Conditions (as herein defined), “we”, “our”, or “us” shall refer to any of the companies within ExcelVite and “you” shall refer to yourself and such other persons or companies represented by you of which you are providing the Personal Data.

You shall be deemed to have accepted this Personal Data Protection Terms and Conditions (“this Terms and Conditions”) and given your consent to us to use your Personal Data when you furnish us with your Personal Data and you access or use this website (“ExcelVite’s site”). If you do not accept this Terms and Conditions herein stated and do not consent to allow us to use your Personal Data, please immediately cease furnishing us with your Personal Data and stop using or accessing the ExcelVite’s site.

We reserve the right to vary, amend and/or change the contents and/or products and/or services offered on the ExcelVite’s site including this Terms and Conditions at any time and without any notice. You shall be deemed to have agreed to and accepted the variation, amendment and/or changes made in the Terms and Conditions when you continue to use or access the ExcelVite’s site. Please review the Terms and Conditions periodically for the variation, amendment and/or change in the ExcelVite’s site.

For the purposes herein, all words and expressions shall have the same meaning as in the Terms and Conditions, except where otherwise expressly stated.

Collection of Personal data

The ExcelVite’s site is committed to ensure the privacy of its users. The information collected by ExcelVite’s site about you will depend on how you use the facilities and features on the ExcelVite’s site.

The information collected will generally include your email address, Login ID, Password, personally identifiable information, gender, age, birth date, address, business information, contact details, and other information which we deemed relevant and any additional information which you subsequently furnish to us, (collectively referred to as “Personal Data”) when you use the ExcelVite’s site. This information is necessary for us to provide the service and/or products you applied for. Personal data provided by you in ExcelVite’s site shall be used for the Purpose as herein stated below.

We also collect information such as the number of users, the date and time of visits, the number of pages viewed and the information downloaded to enable us to monitor the activity on the ExcelVite’s site. In addition to this, we collect personal data when you use the online application forms to apply for our products and/or services and when you complete the survey forms or contact/feedback forms available on the ExcelVite’s site and other places as we deemed relevant.

You hereby confirm that the personal data and other information provided by you is done voluntarily and on a non-proprietary basis, and further warrant and represent to us that the personal data and other information is up-to-date, accurate, complete and not misleading. You agree in the event the personal data and other information provided by you is false, inaccurate, incomplete or misleading, we shall be entitled not to process your personal data, or cancel any potential or existing any transaction with you immediately. We shall, therefore, not be held responsible for any losses, damages, claims, costs and expenses incurred by you as a result of your failure to provide us with up-to-date, accurate, complete and not misleading personal data and information for us to process the personal data for any of the Purposes.

In the event you have furnished us personal data of any third parties (eg: your emergency contact person, authorized representatives etc.) to us, you hereby represent and confirm to us that you have sufficiently obtained the prior consent of such third parties to allow us to process their personal data in relation to the Purpose.

Use and Disclosure of Information

We will keep and process your personal data in a secure manner. We will endeavor, where applicable, to implement the appropriate administrative and security safeguards and procedures in accordance with our policy, the applicable laws and regulations to prevent the unauthorized or unlawful processing of your personal data and the accidental loss or destruction of or damage to your personal data.

The personal data supplied by you through the ExcelVite’s site shall be used, where applicable, for the following purposes:-

(1) to comply with applicable laws and to assist with any government agencies or regulatory authorities including for the purpose of police or regulatory investigation;

(2) for disclosure to any third party requesting your personal data to facilitate any investigation;

(3) to process your request for downloading technical literature / white papers of ExcelVite;

(4) to assess and process your application for the use of ExcelVite’s website;

(5) to respond to your enquiries and communicate with you;

(6) for administrative purposes;

(7) to conduct internal activities including but not limited to internal market survey, trend analysis and other activities

(8) to provide you with the product and services and any other information of the product and services which you require from us;

(9) to collect, retain and store your personal data for our record in our database archive and online portal;

(10) to enroll you for our newsletter;

(11) for advertising and marketing purposes;

(12) to monitor the activity on the ExcelVite’s Site; and

(13) any other purposes directly or indirectly relating to any of the above and our business activities.

(hereinafter collectively referred to as “the Purpose”)

If required for any of the foregoing Purposes or any other purposes for which your personal data was to be disclosed at the time of its collection or any other purposes directly related to any of the above Purposes, your personal data may be transferred to locations outside Malaysia or disclosed to the government agencies, statutory authorities, industry regulators, our auditors, consultants, accountants, lawyers or other financial or professional advisors, our parent company, related corporations, licensees, principals and/or suppliers, business partners and/or service providers, who may be located within or outside Malaysia and any other person and/or organization which we deemed required.

Impact of non-provision of Personal data

In the event you fail to furnish us with your consent for us to process your personal data, and/or subsequently withdraw your consent to process your personal data, and/or furnish incomplete personal data, we may not be able to process your personal data for any of the above Purposes and provide other full range of benefits and/or services and/or perform our obligations under any potential or existing transaction with you, and hence, we may not be able to transact with you. We shall, therefore, not be held responsible for any losses, damages, claims, costs and expenses incurred by you as a result of your supply of incomplete personal data, failure or withdrawal of your consent for us to process the personal data for any of the above Purposes.

Please note that notwithstanding the failure or withdrawal of your consent, we may still proceed to process your Personal Data in circumstances recognized and permitted by law and as required under the contractual conditions, whichever the case may be.

Information Security

You are responsible for maintaining the secrecy of your Login ID and Password when you are using the ExcelVite’s site. We will not be able to secure your information if you reveal your Login ID and Password to anyone.

All your personal data collected from the ExcelVite’s site is stored in secured repositories in our secured data centre.

We take reasonable care to ensure that the ExcelVite’s site is safe and secure, however please be informed that no data transmission over the Internet can be guaranteed as fully secure. As such, we cannot guarantee or warrant the security of any information you send to us through the ExcelVite’s Site. You submit your personal data at your own risk. Once we receive your personal information, we will take all reasonable steps to protect the data held in its system subject to the Terms and Conditions herein.

The ExcelVite’s site may be linked to other web sites but we are not responsible for the privacy practices or the contents of these linked sites. Please read the privacy practices of those linked sites.

Your access to your Personal Information

We regard confidentiality and privacy of your information of paramount importance. Upon request, we may provide you access to the personal data which you have earlier supplied to us. You may submit your written request to us to cancel, update, correct, amend or change your Personal Data to ensure accuracy and completeness of your Personal Data.

Please be informed that we reserve our rights to charge you a reasonable fee for the processing of any data access request.
